Messaging Platform Terms of Service

1. Overview

Spartan IT LLC (“Spartan IT,” “we,” “our,” or “us”) provides communication and automation services that allow businesses to send informational or service-related messages to their customers through channels such as SMS, WhatsApp, or email (the “Service”).
By using or accessing the Service, you agree to these Terms of Service (“Terms”).

These Terms apply to:

  • Client Businesses that use the Spartan IT platform, and
  • End Users who submit a consent form or otherwise receive messages powered by Spartan IT.

2. Our Role

Spartan IT acts as a technology provider and messaging facilitator.
We deliver messages on behalf of our client businesses but do not originate, control, or endorse the specific content of those messages.
Each client business remains solely responsible for the accuracy and legality of its communications.


3. End User Consent

By submitting a messaging consent form or providing your contact information, you authorize the identified business to send you informational or service-related messages via SMS or WhatsApp using Spartan IT’s platform.

  • Message frequency varies by conversation.
  • Message and data rates may apply.
  • You may opt out at any time by replying STOP or request assistance by replying HELP.
  • Consent is not a condition of purchase.

4. Client Business Responsibilities

Businesses using Spartan IT’s platform must:

  1. Obtain valid, documented consent before sending any message.
  2. Comply with all applicable laws and carrier policies (including the U.S. Telephone Consumer Protection Act, CAN-SPAM Act, GDPR, and WhatsApp Business policies).
  3. Maintain their own customer records and promptly honor opt-out requests.
  4. Use the platform only for lawful, professional purposes.

Spartan IT reserves the right to suspend or terminate access if these obligations are violated.


5. Privacy and Data Handling

Spartan IT processes only the minimum information required to provide the Service, such as name, phone number, language, and consent timestamp.
Data may be stored securely on Spartan IT systems or in connected third-party services (e.g., Google Sheets, n8n, or CRM tools) strictly for service delivery and record-keeping.
We do not sell, rent, or share personal data with unrelated third parties.

6. Acceptable Use

You may not use the Service to:

  • Send spam, scams, or deceptive messages.
  • Transmit illegal, abusive, or obscene content.
  • Violate any carrier, WhatsApp, or privacy policy.
  • Interfere with or attempt to access the Service without authorization.

Spartan IT monitors activity patterns for abuse prevention.


7. Intellectual Property

All platform software, design, and documentation are owned by Spartan IT LLC.
Client logos and brand names remain property of their respective owners.


8. Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind, express or implied.
We do not guarantee uninterrupted or error-free operation.
Use of third-party networks (SMS carriers, WhatsApp, etc.) is subject to their availability and terms.


9. Limitation of Liability

To the fullest extent permitted by law, Spartan IT LLC shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the Service.
Our total liability for any claim will not exceed the amount paid to Spartan IT for the portion of Service giving rise to the claim.


10. Indemnification

Client businesses agree to indemnify and hold harmless Spartan IT LLC, its officers, and employees from any claims or damages resulting from their use of the Service, including but not limited to violations of messaging or privacy laws.


11. Termination

Spartan IT may suspend or terminate access to the Service at any time for misconduct, non-payment, or legal compliance reasons.
End Users may withdraw consent at any time by opting out.


12. Updates to These Terms

We may modify these Terms periodically.
Continued use of the Service constitutes acceptance of the updated Terms.
